Understanding Laws Regarding Wrongful Termination

Losing a job can be a frightening and often confusing time. When you know that you were fired from a job without good cause, it can be especially frustrating. There are laws in place that are designed to protect employees from wrongful termination. Wrongful termination is simply the firing of an employee which directly violates that employee’s rights as an employee. In other words, if you are fired without good reason, your employer has violated wrongful termination laws.

You cannot be dismissed from your job without a valid reason, in most states anyway. There are laws set forth by the Equal Employment Opportunity Commission that are designed to protect you from wrongful termination. The Fair Employment and Housing Act protects employees from being fired due to things that are completely out of their control. These include things like disabilities, race, age, religion, color and others.

The Family Medical Leave Act or FMLA grants employees the right to receive up to 12 weeks of unpaid time off without worries of losing their jobs. If an employee is terminated because they have taken FMLA leave, the employer is violating wrongful termination laws. OSHA or the Occupational Safety and Health Act is also designed to protect employees. According to OSHA, employers cannot fire an employee who has in the past or is presently in the process of filing a complaint due to workplace safety. If an employee is fired for this reason, the employer can face heavy fines.

The Civil Rights Act also provides a bit of job protection. Employers are prohibited under Title VII of this act from any discrimination of employees. This means that an employer cannot fire or refuse to hire an employee based on age, race, religion, gender and other personal characteristics. This law also prohibits employers from firing employees who have filed complaints against discrimination.

If at any time an employee feels that he or she has been wrongfully terminated, it is essential to get in touch with an attorney who specializes in these cases. In many instances, compensation may be appropriate and the employee could potentially gain back their employment status. Employers who violate these laws are often fined heavily and in some extreme cases, may be subject to jail time. Employees who do their jobs properly are protected from wrongful termination although these laws do vary from state to state.
